1. MAISON TELLUS WEBSITE AND THE GENERAL TERMS AND CONDITIONS OF SALE
1.1 These General Terms and Conditions of Sale (the “General Terms and Conditions of Sale”), together with the documents referred to herein, govern the sale of TELLUS products and/or services that you may order on the website www.maison-tellus.com (the “Website”).
In these General Terms and Conditions of Sale, the terms “TELLUS”, “we”, “our” and “us” refer to Tellus Watches SAS, a company incorporated under French law with its registered office at 20 rue Fortuny, 75017 Paris, France, operating under the Maison Tellus brand.
These General Terms and Conditions of Sale are separate from the Website Terms of Use and the Privacy Policy, which are also accessible on the Website.
1.2 By using the Website and placing an order on it, you acknowledge that you have read these General Terms and Conditions of Sale and accept them without reservation, as well as the Terms of Use and the Privacy Policy available on the Website, which form an integral part of the agreement concluded between you and TELLUS for any order placed on the Website.
Please ensure that you have read and understood these General Terms and Conditions before using the Website.
If you do not accept the General Terms and Conditions of Sale, you will not be able to place an order on the Website.
2. UPDATE OF THE GENERAL TERMS AND CONDITIONS OF SALE
TELLUS reserves the right, at any time, to modify these General Terms and Conditions of Sale at its sole discretion and without prior notice. The version applicable to the customer's purchases is the one in force on the Website on the date the order is placed. We therefore invite you to consult them regularly in order to stay informed of updates. The latest version of these General Terms and Conditions of Sale will always be the one available on the Website and will take effect as soon as it is published on the Website. By continuing to use the Website, you agree to be bound by the provisions of these updates and successive modifications.
3. ORDER PROCEDURE
3.1 Our order procedure has been established to allow you to check and, if necessary, correct any errors before submitting your order to us. The ordering procedure is as follows:

- Add to cart: Once you have selected a TELLUS product or service, you will be offered the option to add it to your cart. You may then continue shopping or proceed to checkout, subject to product availability.
- Checkout: After selecting the TELLUS products and/or services, you may proceed to checkout either as a guest or through your customer account. You may still adjust your cart by removing selected products and/or services or by adding new ones.
- Verification of order details: At this stage you will be asked to verify the details of your order and your personal information (including email address, shipping address, billing address and payment details). A summary of the order will be presented before you confirm your order.
- Placing the order: Once the verification has been completed, you will confirm your order by proceeding with payment.
We invite you to read and carefully check your order before confirming it. In the event of an error in your order, you must contact us by email or telephone as soon as possible in order to notify us of the error. We will try, as far as possible and without guarantee, to correct the error.
3.2 An email confirming receipt of your order will be sent to you as soon as it has been registered. This email does not constitute final acceptance of your order.
Acceptance of your order will only be confirmed after (i) verification of the availability of the product or service and (ii) the usual legal checks relating to credit verification, fraud prevention and security checks.
If these checks are satisfactory and once full payment has been received in our account, we will proceed with the shipment of your order.
The sending of a shipping confirmation email constitutes acceptance of your order and the formation of the sales contract between you and TELLUS.
3.3 An electronic invoice will be sent to the email address provided during your order. It is important that you enter a valid email address when placing your order.
We recommend that you keep this invoice.
3.4 If a product ordered becomes unavailable after the order has been placed, we will inform you as soon as possible and refund the amounts paid.
3.5 TELLUS reserves the right to refuse, cancel or terminate orders at any time for reasonable grounds, particularly in the event of suspected violation of these General Terms and Conditions of Sale or the Terms of Use, or in the event of a previous dispute with the customer.
4. PRICES AND FEES FOR TELLUS PRODUCTS AND SERVICES
4.1 All prices displayed on the Website are in euros and include applicable VAT.
For orders whose delivery address is located outside the European Union, VAT may be deducted at checkout.
4.2 The prices of our products and services may be modified at any time. However, the price applied will be the one displayed at the time the order is confirmed by the customer.
4.3 The exchange rate applied to your local currency at the time of payment will be determined by your credit card company or bank according to their own terms and conditions.
4.4 In the event of shipment of an order outside the European Union, customs duties and import taxes may be required by local authorities.
These charges remain the responsibility of the customer.
4.5 The total cost of your order will include the price of the goods and the applicable delivery costs. Shipping charges, where applicable, will be indicated separately.
TELLUS will not be obliged to supply a product at an incorrect price if the pricing error is obvious and you could reasonably have recognized it.
4.6 TELLUS takes particular care to ensure that the prices of products and/or services and delivery costs displayed on the Website are correct. However, pricing errors may occasionally occur. In such a case, TELLUS reserves the right to cancel the order after informing the customer.
4.7 If applicable taxes increase between the date of the order and the shipment confirmation, we will contact you and ask you to reconfirm your order.
5. PAYMENT
5.1 Accepted payment methods are those indicated during the ordering process on the Website.
5.2 TELLUS reserves the right to carry out payment security checks.
5.3 When PayPal is offered as a payment method, the order amount may be charged immediately after confirmation.
5.4 Bank transfers may be accepted at the discretion of TELLUS. The order will only be processed once payment has been received.
6. WARRANTY
6.1 We offer a two (2) year international warranty (“TELLUS International Warranty”) against any manufacturing defect or defect in materials, effective from the date of purchase of the watch (the “Warranty Period”).
Our global warranty applies only to products purchased on the Website or from an authorized retailer. If you discover a defect in materials or workmanship in your purchased product and wish to obtain repair or replacement, you must contact our customer service department.
6.2 The TELLUS International Warranty does not cover the following (hereinafter, the “Exceptions”)
-
- theft, loss, force majeure events, natural disasters and accidents of any kind;damage resulting from improper use;
- repairs carried out by third parties not authorized by TELLUS;
- straps (except metal straps);normal wear and tear resulting from normal use and aging of the watch and/or the strap and its buckle or clasp;
- requests for repair of a watch whose warranty has not been activated.
6.3 Any request relating to the use of the TELLUS International Warranty must be accompanied by one of the following documents:
-
- international warranty certificate with stamp, date and product reference;
- the original invoice or original delivery note together with a bank or credit card statement;
- if the product was purchased online on our Website, the invoice number or order number will suffice.
TELLUS will then carry out the usual checks to ensure that the product concerned effectively benefits from the TELLUS International Warranty (or, where applicable, from a warranty extension subscribed on the Website).
6.4 Independently of the TELLUS commercial warranty, the customer benefits from the legal warranties provided under applicable legislation, including:

- the legal guarantee of conformity.
- the guarantee against hidden defects
7. PERSONAL INFORMATION
Personal information collected when placing an order is necessary for the processing of that order. TELLUS treats all personal information as confidential. The conditions under which TELLUS collects and uses the information and personal data you provide are described in our Privacy Policy available on the Website.
8. PRODUCT AND SERVICE INFORMATION
Although we make every effort to ensure that all content published on the Website is accurate and as precise as possible, errors may occur, particularly with regard to the description of products and/or services. TELLUS cannot therefore guarantee that all product images faithfully reflect the actual appearance of the products; all product images must be considered as illustrations. The display of product images may also vary depending on the color settings of your computer or the quality of the screen on which you view the images on the Website.
9. SHIPPING
9.1 Orders may only be shipped to the countries and addresses provided during the ordering procedure described in Article 3 above. For security reasons, we do not ship to certain addresses such as military zones, certain restricted areas, pick-up points or post office boxes.
In the event of an order containing several products, the order will only be shipped once all products are available.
9.2 In the event of delays due to reasons or events beyond our control, we will notify you as soon as possible and will make our best efforts to minimize the consequences of the delay. If delivery of your order does not take place within thirty (30) days (or any other agreed timeframe in the case of customized or made-to-order products) following the date of shipment confirmation or any other timeframe indicated by us, you may contact us to cancel the order and obtain a refund of the amounts paid, without being entitled to any compensation whatsoever.
9.3 TELLUS may require a handwritten or electronic signature from you, or from any person at the delivery address provided, in order to confirm proper delivery of the product. From that moment, the risk and responsibility for the product(s) you have purchased are transferred to you.
In the event of delivery to a third party (for example if the product is a gift), it is agreed that the signature of said third party (or of a person at the delivery address) shall constitute proof of delivery and of the fulfillment of the sales contract by TELLUS, and shall release TELLUS from any liability.
For certain categories of products, TELLUS reserves the right to deliver the products only to the person identified as the recipient of the order as indicated on the parcel label, and to request proof of identity for verification purposes at the time of delivery.
9.4 The transfer of risk occurs when the customer, or their representative, physically takes possession of the product.
10. RETURN POLICY
10.1 You have a fourteen (14) day right of withdrawal from the date of delivery of your TELLUS watch. To exercise this right, you must inform us and request a return authorization code by email from our customer service department (service-clients@maison-tellus.com).
You must indicate in your email the order number corresponding to the product concerned, which you will find in the confirmation email and/or the invoice you received. We will acknowledge receipt of your withdrawal email by providing you with the return authorization code.
You will then have a maximum period of fifteen (15) days from the sending of your withdrawal email to return the product(s) concerned to TELLUS WATCHES SAS, After-Sales Service, 20 rue Fortuny, 75017 Paris, France, accompanied by
-
- the delivery note and the TELLUS return form which will be sent to you in the email confirming receipt of your withdrawal;
- the return authorization code that was provided to you.
10.2 Returned products must be in new and unused condition, in perfect working order, with all protective materials in place and accompanied by the tags and stickers attached to them, as well as the original TELLUS box and packaging, including all accessories and documents. TELLUS reserves the right not to accept any return if the product shows signs of wear, has been used or modified from its original condition in any way, or we may reduce the amount of any applicable refund or exchange accordingly.
Return shipping costs remain the responsibility of the customer unless otherwise indicated.
10.3 If you received complimentary items as part of your order, they must be returned together with the products.
10.4 All returns will be subject to a quality control inspection carried out by us to ensure that the returned products comply with these conditions. If the quality inspection reveals defects, TELLUS may refuse the return and the products will be sent back to you. If the returned product passes the quality inspection, we will proceed with the applicable refund or exchange.
Failure to comply with these General Terms and Conditions of Sale will entitle us to refuse the returned product and return it to you at your expense.
10.5 No return for exchange or refund will be accepted for products that have been personalized, adjusted to the customer’s measurements, or subject to a special order.
11. FORCE MAJEURE
TELLUS shall be released from any liability for damages or penalties in the event of impossibility to perform the contract, delay in its performance or circumstances beyond our control. Factors of exemption from liability include government intervention, the enactment of new laws or the modification of existing laws, absence of State authority, war, fires, floods, labour disturbances, strikes, prohibitions, restrictions, sabotage, adverse weather conditions or transportation issues, failure of suppliers to deliver, or the exposure of the company to criminal activities affecting its operations.
12. GENERAL PROVISIONS
12.1 These General Terms and Conditions of Sale and their successive updates constitute the entire agreement between TELLUS and you concerning the purchase of TELLUS products and/or services on the Website. They replace and extinguish all prior agreements, draft agreements, arrangements, undertakings or ancillary contracts entered into by the parties, of whatever nature, whether oral or written, relating to the purchase of TELLUS products and/or services on the Website.
12.2 If one or more provisions of these General Terms and Conditions of Sale are declared invalid or considered as such pursuant to a law, regulation or final decision of a competent court, they shall be deemed unwritten and the remaining provisions shall remain in force.
12.3 The failure of TELLUS to enforce its rights in relation to a provision of these Terms of Use or any other right relating to these General Terms and Conditions of Sale shall not (i) affect in any way the validity of these General Terms and Conditions of Sale nor (ii) be interpreted or considered as a waiver of its rights to invoke the application of such provision or right, whether for the past or for the future.
13. APPLICABLE LAW AND JURISDICTION
13.1 These Terms of Use are governed by and interpreted in accordance with the provisions of French law, without prejudice to the application of mandatory provisions of the jurisdiction to which you are subject.
13.2 Any dispute, controversy or claim arising out of or in connection with these General Terms and Conditions of Sale, including those relating to their validity, nullity, breach or termination, shall be submitted to the competent courts according to the applicable legal rules.
13.3 In accordance with the provisions of the French Consumer Code, the customer may use a consumer mediation service free of charge.
